New Expungement Law in Effect October 1, 2017

Some criminal convictions are now eligible for expungement under the Justice Reinvestment Act, which went into effect on October 1, 2017.  As a general rule, a case with a Guilty disposition cannot be expunged.  However, some misdemeanor convictions will be expungeable after October 1, 2017, provided they meet certain criteria.

  • The case must be from at least 10 years ago.*
    • The 10 years starts at the end of any jail time or probation imposed.
    • The 10 years does not start from the date of the conviction.
  • You can’t have been convicted of any new crimes since then.
    • Unless the new conviction(s) become expungeable.

*Second degree assault has a 15 year waiting period.
